Come and join our West Midlands regional group for our webinar seminar on development constraint with the focus on the issue of nutrient neutrality and Tree Preservation Orders prosecutions.

We have 3 excellent specialist speakers.

  • Wendy Furgusson, Ramboll: The impact on development in relation to nutrient neutrality. Wendy will discuss the current status of nutrient neutrality requirements across the UK and set out the implications for development and how they may be mitigated.
  • Chris Hopkins, No5 Chambers: The latest legal developments in relation to enforcement of Tree Preservation Orders and its impacts on development.  Chris’s talk on Tree Preservation Orders (“TPO’s”) will provide an overview of the law in this area and also an update on developments in sentencing of TPO offences.
  • Tracy Lovejoy, Irwin Mitchell: The legal basis and requirements relating to nutrient neutrality. Tracy will also touch on the Dutch Nitrogen case which led to moratoriums on development in various places around the country as well as judgments which show the approach which the courts have taken recently in respect of this issue.

 

Wendy Furgusson is an Associate at Ramboll environmental and engineering consultancy, specialising in water quality and contaminated land, particularly nutrients and Water Framework Directive.  Her work focuses on assessing the potential effects of development on the water environment and advising developers on options to mitigate such effects, working with biodiversity and drainage colleagues to develop integrated solutions that facilitate development as well as providing multiple environmental benefits.  Wendy is a Fellow of the Chartered Institution of Water and Environmental Management as well as a Chartered Geologist.

Chris Hopkins is a regulatory barrister at No5 Chambers specialising in environmental, H&S and other regulatory prosecutions and defences. He regularly defends in these cases for private organisations and individuals, and also for public and charitable bodies. Chris is on the List of Specialist Regulatory Advocates in Health and Safety and Environmental Law for the Environment Agency and other regulators, and also prosecutes on behalf of local authorities.

Tracy Lovejoy is a Senior Associate in the Irwin Mitchell Planning & Environment team base in the Birmingham office. She is a planning specialist of 20 years' call with expertise in compulsory purchase, highway and rural matters such as agricultural and farm diversification projects, public rights of way, town and country village greens and commons. Her experience includes providing strategic planning advice to commercial and residential developers as well as estates and farmers.  She has provided advice to developers on mitigating the emission of nutrients, including phosphates in special areas of conservation in residential and agricultural development.  She also has a contentious practice where she deals with appeals  and High Court cases on behalf of developers and private clients.
