Podcast Series with No5 Chambers

Please enjoy our podcast series with our trustee Odette Chalaby and Richard Kimblin KC.  Thank you to No5 Chambers for supporting the series with professional sound production by Rubber Ears.

  • Richard Kimblin KC is joined by the three editors of an insightful and comprehensive book, EU Environmental Principles and Scientific Uncertainty before National Courts – the case of the Habitats Directive, which explores the dynamics that are driving courts across Europe in nature conservation: Mariolina Eliantonio, Emma Lees and Tiina Paloniitty. It looks critically at how decision makers and courts understand and analyse scientific information by reference to the Habitats and Bird Directives - the core of both domestic and EU nature conservation law. listen to podcast

  • Richard Kimblin KC at No5 Chambers is joined by Will Rundle, Head of Legal at Friends of the Earth and Harj Narulla (pupil barrister at No5 Chambers) to help listeners get to grips with two cases on the assessment of climate impacts: in what way do climate change effects have to be taken into account in an ES?; and what can lawfully be left out of account? The case of Finch helps with these questions and we are guided through that judgment, which was decided 2:1. We then turn to the Mozambique case. There, in the opinion of one judge in the High Court, an unreasonable assessment of climate effects can make a decision unlawful. Unusually, two judges sat to hear the case, brought by FoE. One of them found that assessment was irrational. We have a look at why that was so. listen to podcast
